Understanding the Buyer Inspection Waiver in California Real Estate

In California’s real estate landscape, transparency and due diligence are key pillars of a successful transaction. One document that I like to use during the homebuying process is the Buyer Inspection Waiver (BIW), a form provided by the buyer’s agent when a buyer chooses to forgo certain inspections.

What Is the Buyer Inspection Waiver?
The Buyer Inspection Waiver, or BIW, is a standard form issued by the California Association of REALTORS® (C.A.R.) that allows a buyer to formally acknowledge their decision to decline specific property inspections. These might include a general home inspection, pest inspection, roof inspection, or any other specialized evaluations.

Why Is It Used?
While buyers are strongly encouraged to conduct thorough investigations of a property, some may choose to waive certain inspections—whether due to cost, time constraints, or confidence in the property’s condition. The BIW ensures that this decision is documented and that the buyer understands they are proceeding against the advice of their agent and broker.

What Does the Form Include?
The BIW outlines:
  • The types of inspections the buyer is choosing to waive.
  • A clear statement that the buyer has been advised to conduct inspections.
  • Acknowledgment that the buyer is acting independently in waiving them.
  • A reminder that the buyer may still elect to conduct inspections later, within the investigation period specified in the purchase agreement.

Why It Matters
Waiving inspections can carry significant risk. Undiscovered issues—like structural damage, mold, or pest infestations—may not be visible during a walkthrough. By signing the BIW, the buyer accepts responsibility for any future problems that might have been uncovered through inspections.

The BIW isn’t just a formality—it’s a safeguard for all parties. For agents, it documents that proper guidance was given. For buyers, it’s a moment to pause and reflect: Am I comfortable moving forward without this information? In a market where speed and competition often drive decisions, the Buyer Inspection Waiver is a reminder that informed choices are always in style.
